Terms of Service

Dear visitor, by accessing this website www.bestsardiniatrips.com (hereinafter “Site”) and using its content, contact forms or booking/information request features, the user (hereinafter “User”) declares to have read and fully accepts these Terms of Service (hereinafter “Terms”).

Acceptance of the Terms constitutes an agreement between the User and the Site owner (hereinafter “Owner”). The Owner reserves the right to modify the Terms at any time without prior notice. The applicable version is the one published on the Site at the time of access or submission of a request. Each new access to the Site or use of its services implies renewed acceptance of the Terms.

The Site may contain links to third-party sites or applications not managed by the Owner, provided as simple references. Use of such links results in leaving the Site; the Owner declines all responsibility for content, services or damage (direct or indirect) related to the use of third-party platforms. Creating links to the Site without prior written authorisation from the Owner is prohibited.

For interpretive purposes, the Italian language version of these Terms prevails.

The Owner collects and records booking requests submitted by the Customer through the channels indicated on the Site (form, email, phone, messaging). A booking is confirmed only upon explicit confirmation from the Owner.

• The Owner undertakes to respond to requests within 24 hours, confirming or declining availability and
  conditions.
• The Owner only accepts requests from adults (18 years or older).
• At the time of the request, the Customer undertakes to provide truthful information about their own identity and that of any other Participants, and to disclose relevant needs (minors, specific physical conditions, etc.).

• The Customer must be an adult. Minors may participate only if accompanied by a parent or responsible adult, who assumes full responsibility for their conduct and safety.
• Any age limits, physical requirements, recommended equipment and difficulty levels are indicated on each Excursion/Tour page.
• Persons with disabilities or significant medical conditions are required to disclose this at the time of booking, so that compatibility with the activity can be assessed.
• Participants undertake to follow the Guide’s instructions and to maintain responsible and respectful behaviour towards the environment and the group.

Unless otherwise stated on the Excursion/Tour page, the rate includes:

• Transport from the departure point (Orosei or other points indicated by the Owner at booking) to the start of
  the excursion and return
• Fuel for transport
• Entry tickets for destinations that require them (e.g. Su Gorropu gorge, Tiscali Nuragic village)
• Accident insurance for all Participants

Participation with pets is permitted only where expressly stated on the Excursion/Tour page and if the animal
meets the following conditions:

• Is accustomed to walking and to the terrain conditions of the activity
• Is kept on a lead at all times during the activity
• Is in good health and vaccinated in accordance with applicable regulations
• Does not display aggressive behaviour towards people or other animals

Any request to bring a pet must be communicated at the time of booking. The Owner reserves the unquestionable right to refuse the animal’s participation. The owner assumes full responsibility for any damage or incidents caused by the animal. The activity does not include rescue equipment, food or insurance for animals.

Participants are required to:

• Follow the Guide’s or organiser’s instructions at all times
• Maintain civil and respectful behaviour towards all other participants, the environment and wildlife
• Not leave the group without prior notice to the Guide
• Not produce disruptive noise through electronic devices
• Not make audio, video or photo recordings without the consent of those recorded The following are prohibited:
• Consuming alcohol or narcotics before or during the activity
• Carrying weapons or any offensive objects
• Lighting fires, disturbing wildlife or damaging the environment
• Littering along the route
• Smoking during the activity

The Guide may remove from the group any person who fails to comply with these rules, with no obligation to provide a refund.

Excursions/Tours take place subject to adverse weather conditions or force majeure events that may compromise safety. The Owner reserves the right to:

• Modify itineraries for safety reasons or public authority provisions
• Postpone the departure time
• Cancel the activity in the event of adverse conditions, Guide unavailability or unforeseen critical issues

In such cases, an alternative date or another mutually agreed solution will be proposed to the Customer.

Participation in Excursions/Tours involves natural risks associated with trekking and outdoor activities. The Customer/Participant acknowledges that:

• Terrain conditions may vary (rocks, gradients, steep ground)
• Atmospheric conditions may change rapidly
• Unforeseen natural events cannot be controlled by the Owner

The Owner and the Guide are not liable for:

• Injuries arising from inadequate physical preparation or failure to follow instructions received
• Loss or damage to personal belongings
• Events of a fortuitous or force majeure nature
  Liability remains limited to the cases expressly provided for by Italian law.

Cancellation by the Customer

The Customer may cancel a booking free of charge up to 72 hours before the scheduled start of the
Excursion/Tour. For cancellations beyond this deadline or in the event of no-show, any amounts already paid
may not be refunded, unless otherwise indicated in writing by the Owner.

Cancellation by the Owner

The Owner may cancel or interrupt the activity for the following reasons:

• Adverse weather conditions
• Guide health issues
• Unforeseen issues relating to the route or safety
• Public authority provisions
• Conduct of one or more Participants that jeopardises the safety or wellbeing of the group

1. Cancellation within the deadline (more than 72 hours before)
   Any amounts already paid will be refunded in full.
2. Cancellation beyond the deadline or no-show
   The Owner reserves the right to retain the full amount paid.
3. Cancellation by the Owner (force majeure, weather, safety)
   An alternative date will be proposed or, at the Customer’s request, the full amount paid will be refunded.
4. Interruption due to causes not attributable to the Owner
   In the event of early termination due to the Participant’s physical condition, failure to follow instructions or inappropriate behaviour, no refund is provided.
5. Refund method
   Refunds will be made using the same payment method used for the original payment, unless otherwise agreed by the parties.

• Prices indicated on the Site are in euros.
• Prices indicated on the Site may differ from those agreed with the Owner at the time of confirmation.
• In the event of a discrepancy between the price on the Site and the price in the confirmation, the confirmed price prevails.

The Owner reserves the right to occasionally take photographs and video recordings during Excursions/Tours
for documentary and promotional purposes. Such materials may be used by the Owner on:

• Website www.bestsardiniatrips.com
• Official social media channels
• Printed promotional materials

Consent to recording and use of images is requested explicitly at the time of booking. Any Participant who does not wish to be recorded must communicate this at that time; the Owner undertakes to respect this indication. For minor Participants, consent must be given by the parent or responsible adult making the booking. Materials collected are processed in accordance with applicable data protection regulations (GDPR). For further information, see the Privacy Policy on the Site.

These Terms are governed by Italian law. For any dispute, the competent court shall be that of the place of residence or domicile of the consumer, where applicable; otherwise, the competent court shall be that of the Owner.
